
E-3 Visa: U.S. Work Authorization for Australian Nationals
The E-3 visa is a U.S. work visa available exclusively to citizens of Australia. It allows qualified professionals to work in specialty occupations roles that require at least a bachelor’s degree (or equivalent) and involve the application of specialized knowledge.
E-3 Visa Eligibility
To qualify, you must:
- Be a citizen of Australia
- Have a legitimate job offer from a U.S. employer
- Fill a specialty occupation role requiring a bachelor’s degree or higher (or equivalent)
- Possess the appropriate academic qualifications
- Hold a license or certification if required for the occupation
Application Process
Outside the U.S.:
Australian citizens may apply directly at a U.S. consulate with:
- A valid Labor Condition Application (LCA) filed by the employer
- Proof of educational qualifications
- A job offer letter detailing duties, salary, and terms of employment
Within the U.S. (Change of Status or Extension):
File Form I-129 (Petition for Nonimmigrant Worker) along with:
- Certified LCA
- Evidence of qualifications
- Supporting documentation from the employer
Changing Employers
To switch employers while in the U.S.:
- The new employer must file a certified LCA and a new Form I-129
- You must wait for USCIS approval before starting the new job
USCIS may allow a grace period of up to 60 days of continued E-3 status after employment ends, as long as your petition remains valid.
